TERMS AND CONDITIONS

These Terms and Conditions apply to services performed by Task Zero. The customer or client agrees to these Terms and Conditions by approving or accepting a Task Zero proposal, estimate, work order, or other written authorization for services.

1. Scope of Work

Task Zero will perform only the work specifically described in the approved proposal, estimate, or work order (“Scope of Work”). Any work, service, repair, installation, modification, or material not specifically included in the Scope of Work is considered additional work and may result in additional charges. Task Zero is not responsible for work that is outside the approved Scope of Work unless the parties agree to add that work.

2. Estimates and Pricing

Estimates and proposals are based on the information provided by the Customer and conditions reasonably visible or known at the time of estimating. Pricing may change if concealed damage, unforeseen conditions, incorrect measurements or information, inaccessible areas, additional Customer requests, material changes, or other circumstances affecting the work are discovered. Task Zero will make reasonable efforts to discuss significant additional costs with the Customer and obtain approval before proceeding with additional work.

3. Materials

Unless otherwise stated in the proposal, Task Zero may provide standard materials reasonably necessary to complete the approved Scope of Work. Specialty materials, upgraded products, special-order items, Customer-selected products, or materials exceeding an allowance included in the proposal may result in additional charges. Material availability, pricing, appearance, model numbers, and specifications may change without notice due to supplier or manufacturer availability.

4. Customer-Supplied Materials and Products

When the Customer supplies materials, fixtures, appliances, equipment, hardware, or other products, the Customer is responsible for ensuring that those items are suitable, complete, properly sized, and compatible with the intended installation. Task Zero is not responsible for manufacturer defects, missing or damaged components, incorrect dimensions, product incompatibility, product failure, warranty issues, or other problems inherent in Customer-supplied materials or products. Additional labor required because of missing parts, defective products, incorrect products, incomplete assemblies, or compatibility issues may be charged separately. Installation by Task Zero does not constitute a warranty or guarantee of a Customer-supplied product.

5. Payment Terms

Payment terms will be stated in the applicable proposal or estimate. A deposit or advance payment for materials may be required before scheduling or beginning work. Progress payments may be required for larger or multi-stage projects. Unless different terms are stated in writing, the remaining balance is due upon completion of the approved Scope of Work. Additional work, approved changes, additional materials, or other authorized charges will be added to the final amount due. Failure to make payment when due may result in suspension of work, collection activity, and other remedies available under applicable law.

6. Changes and Additional Work

Changes to the approved Scope of Work should be authorized by the Customer before the additional work is performed. Authorization may be documented through a revised proposal, written change order, electronic communication, text message, or other written approval. Additional work may be billed at an agreed labor rate plus materials or at a separately agreed fixed price. Minor adjustments reasonably necessary to complete the approved Scope of Work do not necessarily constitute a change order unless they materially affect the price or nature of the work.

7. Scheduling and Delays

Start dates, appointment times, and estimated completion dates are estimates unless Task Zero specifically agrees otherwise in writing. Schedules may be affected by weather, material availability, delivery delays, site conditions, concealed conditions, Customer-requested changes, emergencies, illness, equipment problems, delays caused by third parties, or other circumstances beyond Task Zero’s reasonable control. Task Zero is not responsible for reasonable delays resulting from circumstances outside its control.

8. Customer Responsibilities and Site Access

The Customer is responsible for providing Task Zero with safe and reasonable access to the property and work area at the agreed time. Unless otherwise included in the Scope of Work, the Customer is responsible for moving or protecting furniture, valuables, electronics, personal property, vehicles, pets, and other items that could interfere with the work. The Customer must disclose known conditions that could reasonably affect the work, including known water damage, structural problems, hazardous materials, concealed utilities, unusual wiring or plumbing conditions, or previous repairs that may affect the project. The Customer represents that they own the property or otherwise have authority to authorize the requested work.

9. Concealed, Hazardous, and Unforeseen Conditions

Estimates do not include conditions that could not reasonably be identified before work began. These conditions may include concealed damage, rot, water damage, mold or suspected mold, asbestos or suspected asbestos-containing materials, lead-based materials, pest damage, structural deficiencies, improperly installed existing components, concealed electrical wiring, plumbing or utilities, code violations, or other hazardous or abnormal conditions. Task Zero may stop work when such a condition is discovered until the condition can be evaluated and an appropriate course of action determined. Any investigation, remediation, repair, specialty contractor work, additional labor, or materials required because of these conditions are outside the original Scope of Work unless specifically added in writing.

10. Right to Suspend or Stop Work

Task Zero may suspend or stop work when reasonably necessary because of unsafe conditions, hazardous materials, nonpayment, denied or inadequate access, undisclosed site conditions, Customer interference, work requiring licensing or qualifications outside Task Zero’s authorized scope, or other conditions that make continued work unsafe, unlawful, or impractical. The Customer remains responsible for properly completed work, materials purchased for the project, and other authorized costs incurred before work is suspended or terminated.

11. Workmanship

Task Zero will perform the approved Scope of Work in a professional manner consistent with generally accepted handyman practices and the nature of the work being performed. Any specific workmanship warranty offered by Task Zero will be limited to the warranty expressly stated in the applicable proposal, estimate, or other written agreement. No warranty should be interpreted as requiring Task Zero to correct problems caused by conditions or work outside Task Zero’s responsibility.

12. Warranty Exclusions

Unless specifically stated otherwise in writing, warranties do not cover: normal wear and tear; misuse, abuse, neglect, or improper maintenance; Customer-supplied materials or products; manufacturer defects; damage or alterations caused by the Customer, another contractor, or a third party; pre-existing conditions; concealed conditions; movement, settling, moisture intrusion, or structural conditions; or problems resulting from circumstances outside Task Zero’s reasonable control. Manufacturer warranties, when applicable, remain subject to the manufacturer’s own terms and conditions.

13. Contractor Scope, Permits, and Code Requirements

Task Zero performs only work that it is legally authorized and qualified to perform under applicable Alaska law. Task Zero will not perform work requiring a license, endorsement, administrator, certification, or other professional qualification that Task Zero does not possess. Work requiring a licensed specialty contractor, electrical or mechanical administrator, residential contractor endorsement, engineering, professional design, inspection, or other specialized qualification may be excluded from the Scope of Work or referred to an appropriately qualified professional. Unless specifically included in the proposal, permit fees, engineering, professional design services, inspections, and specialty trade services are not included in Task Zero’s pricing. When operating under an Alaska handyman contractor designation, Task Zero will not undertake a project exceeding the aggregate contract-price limitation established by Alaska law. The aggregate project price includes labor, materials, and other items applicable to the project. A project will not be divided into separate contracts for the purpose of avoiding an applicable legal limitation.

14. Cleanup and Disposal

Task Zero will make reasonable efforts to leave the immediate work area reasonably clean following completion of the work. Routine cleanup associated with Task Zero’s work is included unless otherwise stated. Removal or disposal of unusually large quantities of construction debris, existing fixtures, appliances, hazardous materials, abandoned property, or other materials may require an additional charge unless specifically included in the Scope of Work.

15. Photographs and Documentation

Task Zero may photograph or otherwise document the work area before, during, and after work for estimating, project documentation, quality control, insurance, warranty, or dispute-resolution purposes. Project photographs identifying the Customer, occupants, private information, or the specific property will not be used for advertising or promotional purposes without appropriate permission.

16. Cancellation and Rescheduling

The Customer should notify Task Zero as soon as reasonably possible if a scheduled project or appointment must be cancelled or postponed. If the Customer cancels or postpones work after materials have been purchased, special-order items have been ordered, or work has begun, the Customer may be responsible for non-refundable material costs, restocking or cancellation charges, completed labor, and other reasonable costs already incurred, subject to applicable law. Nothing in these Terms and Conditions limits or waives a Customer’s cancellation rights provided by applicable law. Where Alaska law provides a statutory cancellation period or requires a separate cancellation notice, those requirements and rights will apply.

17. Pre-Existing Property Conditions

Task Zero is not responsible for damage resulting from deteriorated, defective, improperly installed, previously damaged, or otherwise compromised existing materials or components when the condition was not caused by Task Zero. This includes, as applicable, brittle materials, deteriorated drywall, damaged framing, corroded fasteners, aging plumbing components, improperly installed fixtures, damaged finishes, hidden water damage, and similar pre-existing conditions. If continued work could reasonably cause additional damage because of an existing condition, Task Zero may stop work and discuss available options with the Customer.

18. Third-Party and Specialty Services

When work outside Task Zero’s Scope of Work or authorized contractor classification is required, the Customer may need to retain an appropriately licensed or qualified third party. Unless specifically stated otherwise in writing, such third parties are not employees or agents of Task Zero, and their services, pricing, scheduling, warranties, and workmanship are separate from Task Zero’s services.

19. Completion and Customer Inspection

The Customer should inspect the completed work within a reasonable period following completion and promptly notify Task Zero of any concerns regarding the approved Scope of Work. Completion means that the work specifically identified in the approved Scope of Work has been substantially performed. Minor adjustments, touch-ups, manufacturer backorders, or other insignificant outstanding items do not necessarily prevent the work from being considered substantially complete when the intended work can reasonably be used for its intended purpose. Any additional work requested after completion of the approved Scope of Work may be treated as a separate service request.

20. Acceptance of Proposal and Terms

By signing, electronically accepting, approving, or otherwise authorizing a Task Zero proposal, estimate, or work order, the Customer acknowledges that they have had an opportunity to review the Scope of Work, pricing, payment terms, and these Terms and Conditions. The proposal or estimate and these Terms and Conditions together constitute the agreement governing the approved work unless Task Zero and the Customer agree otherwise in writing. The version of these Terms and Conditions in effect on the date the Customer accepts the proposal or estimate will apply to that project. If a specific provision in an accepted written proposal conflicts with these general Terms and Conditions, the specific provision in the accepted proposal will control with respect to that project.

21. Applicable Law

These Terms and Conditions and services performed by Task Zero are governed by applicable federal, State of Alaska, and local laws and regulations. Nothing contained in these Terms and Conditions is intended to waive or restrict any right or remedy that cannot legally be waived or restricted. If any provision of these Terms and Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
